LAKE FOREST SWIM AND DIVE TEAM ASSUMPTION OF RISK AND WAIVER OF LIABILITY In consideration of the permission being granted by Lake Forest Community Association, Inc. (the “Association”) to my minor children and any minor household guest of mine (the “Participants”) to participate on the Lake Forest Swim & Dive Team (the “Activity”) and to use the pool and related facilities at the Association’s lodge and any other community pool at which swim and dive meets are held (the “Premises”), I, the undersigned, hereby agree on behalf of myself, the Participants, and my family, guests, heirs, successors, assigns and estate as follows: 

I assume all risks and responsibilities associated with the Activity, including but not limited to the use of, and being present on the Premises and any risk of illness or death related thereto such as that associated with COVID-19. I agree to hold harmless, defend, indemnify and forever release and discharge the Association and its lot owners, directors, officers, employees and agents (“Indemnified Parties”), from and against any liability, loss, cost, damage, claim, demand, proceeding, action in respect thereto and expense, including reasonable attorneys’ fees and costs, incurred or suffered by me, the Participants or any other member of my family or guest on account of, or arising from the Activity or being on the Premises, including but not limited to any injury or damage to personal property that I or any other person may suffer. I covenant not to sue the Indemnified Parties and shall indemnify them from any expense they incur to defend any claim released hereunder, including reasonable attorneys’ fees and costs. 

This assumption of risk and waiver of liability shall be governed, construed and enforced in accordance with the laws of Kentucky to the exclusion of the laws of any other state or country and shall be binding upon my heirs, successors and assigns. I hereby agree to settle any disputes under this Agreement in a court of competent jurisdiction in Jefferson County, Kentucky to the exclusion of the courts of any other state or country, and I hereby consent to such jurisdiction and venue for such purposes and hereby waive, to the fullest extent of applicable law, any objection to such selection and any right to contest such jurisdiction or venue. 

BY SIGNING BELOW I ACKNOWLEDGE THAT I HAVE READ AND FULLY UNDERSTAND THE MEANING AND EFFECT OF THIS AGREEMENT, THAT I AM ENTERING INTO THIS AGREEMENT FREELY AND VOLUNTARILY, THAT I INTEND TO BE LEGALLY BOUND HEREBY AND THAT ITS EXECUTION IS A MATERIAL INDUCEMENT TO THE PERMISSION GRANTED HEREBY.

By registering my child(ren) with the Lake Forest Swim & Dive, and in consideration for allowing my child(ren) to participate, I agree to participate (and allow my child(ren) and family members to participate) in the Lake Forest Swim & Dive program, and hereby release Lake Forest Swim & Dive and the Lake Forest Community Association, Inc. and their respective directors, officers, agents, Board members, meet workers, sponsors, officials, coaches, employees and volunteers (collectively "Lake Forest") from all claims, inlcuding negligence claims, and any costs, demands or liability in any way arising out of or in connection with injuries sustained by any person in any way related to or arising out of participation in the Lake Forest Swim & Dive program, including travel to or from practice sessions, swim or dive meets, or other team activities. I assume all risks and hazards incidental to such participation.

I also agree to hold Lake Forest harmless from and against any and all liability, legal or equitable claims, suits or expenses (including attorney's fees and costs), that may be asserted by any person against Lake Forest arising out of or in connection with injuries (including but not limtied to injuries resulting in death to me, my child(ren) or other family members) or property damage sustained by any person in any way related to my (or my child(ren)'s participation in the Lake Forest Swim & Dive program. I agree to, at my own expense, defend and indemnify Lake Forest against any and all such claims even if they are groundless, false or fraudulent.

I further agree that my child(ren) will obey the coaches, instructors and other adults working in the program or at the meets. I also ackowledge that my child(ren) and I are responsible if I fail to sign my child(ren) up for any meet by the deadline or if my child(ren) misses any events during a meet.

I grant to Lake Forest Swim & Dive Team, its representatives and employees the right to take photographs of me and my child(ren) in connection with participation in the Lake Forest Swim & Dive Team. I authorize Lake Forest Swim & Dive Team, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that Lake Forest Swim & Dive Team may use such photographs of me and/or my child(ren) with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and Web content.

I also agree to allow Lake Forest Swim & Dive team to list my family's name and contact information in a swim and dive team directory that will be provided ONLY to other members of the Lake Forest Swim & Dive Team for use ONLY with swim and dive related issues.

Every swim family is required to work 2.5 meets. If your child goes to Quals or Champs you will be asked to work at least one of those meets in addition to regular season requirements. Failure to complete the volunteer requirements will result in an additional charge to your credit card in the amount of $100.00 per meet missed for a maximum charge of up to $300.00 for the season. You will notice this conditional charge held on your credit card at the end of the registration process. Nothing will be charged unless conditions for volunteering are not met. You will be notified in the event a conditional fee is charged.  

Please choose all your volunteer jobs for the season prior to the first meet in June.  

Swim meet and volunteer signups will open in May.  At that time, you may choose the meets you would like your swimmer(s) to attend and volunteer assignments at the same time. More information to come for those opening dates.  

Dive team members only - the conditional charge is for swim only.  It will show up on your payment screen but you do not have volunteer requirements that must be met. Therefore, that amount will never be charged.
